Delegation of NHS England Direct Commissioning Functions Evaluation and Monitoring of Services Directions 2026
A Direction given by the Secretary of State for Health and Social Care requiring NHS England to collect and analyse information from health and care bodies relating to services commissioned by Integrated Care Boards (ICBs) in England by virtue of NHS England’s delegation of its direct commissioning functions (Delegated Functions) to them under section 65Z5 of the 2006 Act.
Purpose
The purpose of these Directions is to require NHS England to collect and analyse information from health and care bodies relating to services commissioned by Integrated Care Boards (ICBs) in England by virtue of NHS England’s delegation of its direct commissioning functions to them under section 65Z5 of the 2006 Act.
In May 2022, NHS England set out its plans and roadmap for the delegation of its direct commissioning functions to ICBs
It is anticipated that there will be multiple data collections within the scope of these Directions. Each collection will have a requirements specification published alongside these Directions as may be updated periodically by the Secretary of State in consultation with NHS England.
Legal basis
Sections 254(1), (2)(b) and (6), 254(2)(b), (5) section 260(2)(d), section 261(2)(e) and section 304(9), (10) and (12) of the Health and Social Care Act 20121 (the 2012 Act) and sections 13ZC and 272(7) and (8) of the National Health Service Act 20062 (the 2006 Act) These Directions come into force on the date they were signed.
